Display Installation, Receipt & Liability Confirmation

This Installation, Receipt, and Liability Confirmation (“Confirmation”) is entered into by Driver in favor of Bluberd, Inc. (“Bluberd”).

1. Installation Confirmation

Driver acknowledges that Bluberd (or its authorized technician) has installed one (1) digital display unit (the “Display Unit”) on Driver’s vehicle (the “Vehicle”).

2. Device Identification

Device and vehicle identification, including but not limited to display serial number, vehicle details, and license plate information, are recorded at the time of installation and are incorporated into this agreement by reference.

3. Condition at Installation

Driver acknowledges that the condition of the Display Unit at installation is fully documented through photographs, video, and installation records captured at the time of installation.

4. Receipt and Custody

  • Receipt of the Display Unit
  • The Display Unit is the sole and exclusive property of Bluberd
  • Driver assumes full care, custody, and control of the Display Unit immediately upon installation

5. Strict Liability for Loss or Damage

Driver acknowledges that the Display Unit is used for commercial advertising purposes and that any loss, theft, damage, or impairment may result in additional damages, including but not limited to lost revenue, service interruption, and operational disruption.

Driver agrees:

  • To be fully and personally responsible for any loss, theft, damage, or impairment of the Display Unit
  • That such responsibility applies regardless of fault, cause, or circumstance
  • To pay the full replacement cost of the Display Unit and all associated costs, expenses, and damages incurred by Bluberd, including but not limited to lost revenue, service interruption, and operational disruption
  • That such payment shall be made promptly upon demand

Driver agrees that Bluberd shall be entitled to pursue all available legal remedies to recover such amounts.

Driver acknowledges that any amounts owed under this agreement may be recovered through authorized payment methods on file, including but not limited to ACH debit authorization agreements executed by Driver.

6. No Tampering / Use Restrictions

  • Driver shall not remove, relocate, or alter the Display Unit
  • Driver shall not tamper with wiring, power, or components
  • Driver shall not obstruct or interfere with display visibility

7. Operational Acknowledgment

  • The Display Unit powered on successfully
  • Connectivity was verified
  • The unit was visibly operational

8. Reference to Master Agreement

This Confirmation supplements and incorporates by reference the Bluberd Driver Participation, Equipment License, and Liability Agreement previously executed by Driver. In the event of any conflict, the terms of that agreement shall control.

9. Evidentiary Record

Driver acknowledges and agrees that:

  • Photographs, installation records, timestamps, and system data collected at installation
  • Shall serve as binding evidentiary support of installation, condition, and receipt

10. Binding Acknowledgment

This agreement may be executed electronically. Driver agrees that an electronic signature shall be deemed valid and legally binding.

  • Confirms that all information, photographs, and documentation collected at the time of installation are accurate and complete
  • Acknowledges that such information is incorporated into and forms part of this agreement
  • Accepts possession and full responsibility of the Display Unit
  • Agrees to be legally bound by this Confirmation

This agreement is binding upon acceptance through digital acknowledgment, including electronic signature and confirmation within Bluberd systems.
